1. Agreement to Terms

By accessing or using augustnalways.com, designing products using our interactive customizer, submitting booking inquiries, or placing a purchase order, you agree to be bound by these Terms of Service. If you do not agree to all of these Terms, you are expressly prohibited from using the site and must discontinue use immediately.

2. Purchases, Ordering, and Pricing

By completing a purchase on our website, you agree to pay the fees and applicable taxes and shipping charges specified at checkout:

• Currency & Taxes: All prices are listed in U.S. Dollars (USD). You are responsible for paying any sales, use, or local transaction taxes applied at checkout based on your shipping destination.
• Order Acceptance: We reserve the right, at our sole discretion, to refuse, limit, or cancel any orders. This includes cases where product information is listed inaccurately, transaction authorization fails, or uploaded content violates our safety and community standards.
• Payment Processing: Transactions are handled securely using Stripe Checkout. By purchasing, you authorize Stripe to charge your designated payment method for the total amount of your order.

3. Custom Products and Content Guidelines

Our products are made-to-order based on the photos and artwork you upload. By uploading photographs, drawings, or text to our Customizer, you represent, warrant, and covenant that:

• You own the content, or you have obtained all necessary licenses, copyrights, and permissions from the original creator or legal owner to use, crop, and print it.
• The content does not infringe, misappropriate, or violate the copyright, trademark, privacy, publicity, or proprietary rights of any third party.
• The content does not contain unlawful, harassing, defamatory, threatening, obscene, sexually explicit, abusive, or hateful materials.

Content Review & Refusal: We do not pre-screen all uploads, but we reserve the right to review and reject any custom order containing photos that we determine, in our sole judgment, violate these standards.

Limited Production License: You retain full ownership of your uploaded media. By submitting an order, you grant August & Always a non-exclusive, royalty-free, worldwide, limited license to crop, compress, store, duplicate, and print your photos solely to manufacture, pack, ship, and fulfill your ordered magnets. We will never use your custom photos for promotional or marketing purposes without your separate, explicit written consent.

4. Returns, Replacements, and Refund Policy

Because our cellophane-wrapped photo magnets are handcrafted and custom-printed with your unique, personal images, **all sales of custom products are final**. We cannot accept returns or offer refunds for a change of mind, incorrect cropping choices, or user error.

• Defective or Damaged Keepsakes: If your magnets arrive damaged, defective, or with printing errors made by us, please contact us at [email protected] within **14 days** of delivery. Include your order ID and a photograph of the damaged product. We will gladly manufacture and ship a free replacement or issue a full refund.
• Lost Packages: If your tracking shows no delivery activity within **21 days** of the shipping date, contact us to initiate a carrier investigation. We will resend your custom keepsakes or issue a refund once lost status is verified.
• Low-Resolution Upload Warnings: We recommend uploading sharp, high-contrast photos with a minimum resolution of **800px × 800px** (1200px × 1200px is ideal) to ensure crisp details. We cannot issue refunds or replacements for magnets that print blurry, pixelated, or out of focus due to low-resolution source files provided by the customer.

5. Shipping and Delivery

We ship custom keepsakes to domestic addresses within the United States. Risk of loss and title for all products purchased pass to you upon our delivery of the package to our designated shipping carrier (such as USPS). Estimated manufacturing and delivery timelines provided during checkout are good-faith estimates and do not constitute guaranteed arrival dates.

6. Limitation of Liability

To the maximum extent permitted by applicable law, August & Always and its owners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or related to your use of the site or purchases made. In no event shall our aggregate liability for all claims exceed the total purchase price paid by you for the specific transaction giving rise to the claim.

7. Indemnification

You agree to defend, indemnify, and hold harmless August & Always and its owners from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal and accounting fees) arising out of or in any way connected with your violation of these Terms of Service, or any copyright, trademark, or intellectual property infringement claims arising from the custom photos you uploaded for printing.

8. Governing Law

These Terms of Service and any transactional disputes arising out of your purchases shall be governed by, and construed in accordance with, the laws of the State of Texas, without regard to its conflict of law principles.

9. Changes to Terms

We reserve the right to update, modify, or replace these Terms of Service at any time. Any changes will be posted directly on this page, and the "Last updated" timestamp at the top will be updated. We encourage you to review these terms periodically to stay informed.
